Privacy Policy

Fanvertise.com Privacy Policy Current as of: March 6th, 2011

Fanvertise.com respects your privacy. In everything we do, we want to protect your personal information. Our privacy policy applies to every service offered by Fanvertise.com. We do our best to only work with companies that have a similar approach to protecting user data, but our policy does not apply to companies that Fanvertise.com does not own or manage.

We are in an ongoing process of considering whether or not to participate in the US Department of Commerce's Safe Harbor program. One of the reasons we are still debating is because the Safe Harbor program is primarily directed at the sale and/or transfer of personal information from one company to a third party; as Fanvertise.com does not sell or transfer personal information, the Safe Harbor program does not appear at this time to be applicable to Fanvertise.com. We DO adhere to the Notice, Access, Security, Data Integrity, and Enforcement clauses of the seven-clause Safe Harbor policy. The Choice and Onward Transfer portions of the Safe Harbor policy do not apply to Fanvertise.com. Since we will never transfer or sell your information, choosing whether or not to allow us to sell your information and doing so safely do not come into play. If you have any questions, please contact us at your convenience and we will do our best to answer any questions you may have.

INFORMATION COLLECTION AND USE

Fanvertise.com collects information about you when you visit our site, register for an account, or use one of our widgets. We may collect and use (but never transfer or sell), the following types of information: name, address, phone number, email, birth date, gender, interests, occupation, and other similar types of personal information. We may combine the information you provide us with information about you that we receive from our business partners or other companies. We will never provide any information you give us to any other party not affiliated with Fanvertise.com. We use PayPal as a payment transfer system, so we will never ask you for a credit card number or bank account information. If you receive a request from Fanvertise.com asking for financial information, it is NOT from us, and we ask that you forward that request to phish-alert@fanvertise.com. Fanvertise automatically receives, collects, and stores information from your computer and browser, including but not limited to your IP address, (if utilized) a Fanvertise cookie, software and hardware characteristics, and your URL history for tracking purposes. We use the information you provide us and that we collect for the following purposes: to provide you with the pages and products you are searching for, to track product popularity, to assist content creators in finding out what their fans want, to conduct market research, contact you if necessary, and for any law enforcement purposes upon legal requisition.

CHILDREN

We do not allow the creation of Fanvertise.com accounts by children under the age of 13. We allow the creation of accounts by persons between the age of 13-17, but we will not pay out Fanvertiser dollars to those persons. In the username search field, any username belonging to an underage Fanvertiser will not appear as part of the search results. Having your birthday appear as part of your profile is an option for any Fanvertiser except for underage Fanvertisers whose birthday will never appear in the birthday field of their Fanvertiser user profile. Upon the request of a parent, the account of any underage Fanvertiser will be deleted.

INFORMATION SHARING AND DISCLOSURE

Fanvertise.com does not rent, sell, or share personal information about you with other people or non-affiliated companies except under the following circumstances: 1. We must respond to a subpoena, court order, or legal process, or to establish or exercise our legal rights or defend ourselves against legal claims. 2. In good faith we believe we must share information to investigate, prevent, or take action regarding illegal activities, suspected fraud, or any situation involving the imminent threat of any kind of harm to Fanvertise.com's rights, property, or safety, its users, the public, or as otherwise required or permitted by law. 3. If Fanvertise.com is acquired by or merged with another company, we will notify you before any information about you is transferred and becomes subject to a different privacy policy.

COMMUNICATION

When you send us email or any other communications, we may retain and/or archive those communications to help you, process your inquiries, or improve our services. We will not release your communications to any third parties except as covered under the information sharing and disclosure policy. One of the key parts of the Fanvertise web site is the ability to track clickthrough data and redirect URLs to provide users, Fanvertisers, content creators, and others with the services that Fanvertise provides. We may use information about the patterns used in clicking through a given link (or the link's structure itself) to try to improve our services. We may aggregate user information into market trends, projections, or mapping of financial data. Fanvertise.com retains the right to aggregate data for the purposes of analysis, improvement, research and development, and sharing with our business partners and other parties. Such information will never identify you individually. Fanvertise.com processes personal information on servers housed in the United States of America only. We will not collect or use sensitive information for purposes other than those described in this Privacy Policy and/or in the supplementary service privacy notices, unless we have obtained your prior consent. You always have the right to decline to submit personal information to any of our services, in which case Fanvertise.com may not be able to provide those services to you.

SECURITY

We take appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of data. These include internal reviews of our data collection, storage and processing practices and security measures, as well as physical security measures to guard against unauthorized access to systems where we store personal data. We restrict access to personal information to Fanvertise employees, contractors and agents who need to know that information in order to operate, develop or improve our services. These individuals are bound by confidentiality obligations and may be subject to discipline, including termination and criminal prosecution, if they fail to meet these obligations.

INTEGRITY

Fanvertise.com processes personal information only for the purposes for which it was collected and in accordance with this Privacy Policy. We review our data collection, storage, and processing practices to ensure that we only collect, store and process the personal information needed to provide or improve our services. We take reasonable steps to ensure that the personal information we process is accurate, complete, and current, but we depend on our users to update or correct their personal information whenever necessary.

ACCESSING AND UPDATING PERSONAL INFORMATION

When you use Fanvertise.com services, we make good faith efforts to provide you with access to your personal information and either to correct this data if it is inaccurate or to delete such data at your request if it is not otherwise required to be retained by law or for legitimate business purposes. We ask individual users to identify themselves and the information requested to be accessed, corrected or removed before processing such requests, and we may decline to process requests that are unreasonably repetitive or systematic, require disproportionate technical effort, jeopardize the privacy of others, or would be extremely impractical (for instance, requests concerning information residing on backup tapes), or for which access is not otherwise required. In any case where we provide information access and correction, we perform this service free of charge, except if doing so would require a disproportionate effort. You can deactivate your Fanvertise.com account by visiting your Account Settings page.

CHANGES TO THIS PRIVACY POLICY

Please note that this Privacy Policy may change from time to time. We will not reduce your rights under this Privacy Policy without your explicit consent, and we expect most such changes will be minor. Regardless, we will post any Privacy Policy changes on this page and, if the changes are significant, we will provide a more prominent notice such as a post to the Fanvertise.com home page (and including, for certain services, email notification of Privacy Policy changes). Each version of this Privacy Policy will be identified at the top of the page by its effective date, and we will also keep prior versions of this Privacy Policy in an archive for your review.
