Fanvertise Underage User Policy

PLAIN SPEECH FOR UNDERAGE FANVERTISERS AND THEIR PARENTS OR GUARDIANS

My name is Tarah, and I recommend that if you are under the age of 18 you keep a close watch on your personal information while at Fanvertise.com or at any other internet website.  We watch our information too, because more than your bank account is at risk if you give information like your personal email address, phone number, home address, phone number, social security number, picture, or location to a stranger on the internet, no matter how convincing or charming that person may be.  You must have the permission of your parents to get a Fanvertise account, and by signing up for a Fanvertise account, you are saying that you asked and received that permission.

Please, wait until you are 13 years of age to get a Fanvertise account, and 18 years of age to get a remunerative (meaning it pays you money) Fanvertise account.  If we find out that you have created a false account for any reason, we will ban you for life from the site, and we happen to think that Fanvertise is too cool a site to be banned from for all eternity.  In addition, we don't allow the creation of Content Creator accounts for people under the age of 18.  It's because we collect extra information from you to do so, and we don't want to have to delete Content Creator accounts if your parents ask us to.  

As harsh as this policy may seem concerning underage users, it isn't just that we want to protect ourselves from legal liability (meaning we don't want to get sued).  Websites that are social and contain user-generated content (information posted and shared by the people who use the site, not just those who own it) are always a target of online predators.  While we want to hear what you young whippersnappers have to say, we have every intention of preventing as much abuse as we can, both by penalizing people who create false accounts on Fanvertise, and those who may use our site to try to get information about young users.  Rest assured, getting banned for life (and possibly penalized for any money you took under false pretenses--see the legalese below) is probably the worst thing we'll ever want to do to you if you create a false account.  Getting banned will be only the beginning of an extremely unpleasant experience with the police for anyone we find preying on younger Fanvertisers, though.

Parents, you should be monitoring your children's internet use.  Frankly, if you're even reading this, you're a champion parent anyway.  If you're still with me, let me offer you a small selection of parental control software you can use.  I've never used any of it, but there's lots of information out there; please treat these links as a public service, not a recommendation of their product.

In addition, if young people have access to your computer, make sure to keep your username, password, and other information relating to your Fanvertise account in a safe, confidential place so that the kids can't get to it.  Also, don't leave your computer unattended while logged into your Fanvertise account (or any other web account, for that matter).

If you request it of us, we will always delete the account of your underage child, and purge our databases and other information storage devices of any personally identifiable information.  To have us do that, send an email to underage-alert@fanvertise.com with the full name and Fanvertise username of your child.  In the subject line, please paste this line: "DELETE MY CHILD'S ACCOUNT".  Please give us your name, address, and phone number in the email.  Please attach to that email a photocopy of your driver's license or state-issued identification card, as well as a photocopy of your child's birth certificate showing you as a parent (court papers specifying guardianship of the child are also acceptable as long as they also show the child's birth date).  Please don't worry about us using that information; we will archive those images in encrypted form and delete them after we've checked to make sure you actually are the child's parent.  I don't consider those photocopies of your ID to be information that Fanvertise has a right to use for any other purpose than confirming your identity and deleting your child's account. 

I recommend that you come back here every so often to see if our policy has changed.  If we do any major revisions of the policies, we'll post it on the site and send out emails if that's feasible.

Please read below for the legalese.

In accordance with Section 6502 of the United States Federal Trade Commission's Children's Online Privacy Protection Act of 1998 (Available online at: http://www.ftc.gov/os/1999/10/64fr59888.htm), Fanvertise, LLC ("Fanvertise") does not permit the creation of accounts by children under the age of 13.  Fanvertise does not knowingly collect any information from children under the age of 13.  Upon notification of unintended collection of personal information from a child under the age of 13 (e.g. if a child under the age of 13 has misrepresented their age to create a Fanvertise user account), Fanvertise will make a good faith effort to immediately and completely purge that child's personal information from all current and past information storage devices, software, databases, or other methods of data storage owned or operated by Fanvertise.

Fanvertise policy allows individuals who are 13 years of age and older to register for the
site. If you believe you have identified a Fanvertise user who is underage, please report the following to underage-alert@fanvertise.com:

  (1) The Fanvertise username of the person you believe to be underage, and the URL of their profile.
  (2) Your relationship to that person.
  (3) The actual age of that person and how you know it.
  (4) Your name, address, phone number, email address, and occupation.

We ask for the information from you to ensure that we have the necessary data to follow up on your claim before deleting Fanvertise accounts.  Fanvertise always takes action against any user misrepresenting their age on their profile.  A user who misrepresents their age on any Fanvertise page, user profile, comment, post, or other content creation can expect to have their account deleted. It is the responsibility of Fanvertise account holders to verify that they are legally entitled to partake of the services offered by Fanvertise.

By traveling to Fanvertise.com or any of its affiliate websites (e.g. Fanvertise.net, Fanvertise.us, etc), you agree that:

   (1) You have reached the minimum age at which you are permitted by Fanvertise policy to create a Fanvertise account.
   (2) If between the ages of 13-18, you are permitted by the laws appertaining unto your legal jurisdiction to utilize the services of Fanvertise.com and its affiliates, and have the permission of your parent or guardian to create a Fanvertise account.
   (3) You are solely responsible for complying with the laws of your legal jurisdiction, and you continue to use this website's services at your own discretion and your entire risk.

Fanvertise will not knowingly transfer monetary funds to minors. Fanvertise cannot advise as to the legality of the use of any of the services provided on this website, or of transfer payments in your legal jurisdiction. If you are in any doubt as to the legality of your participation in the services offered by Fanvertise, or you cannot agree to any of the terms numbered 1-3 above, you should discontinue your use immediately and seek professional legal advice before continuing.

Fanvertise accepts no liability for any fine, penalty, loss, or other criminal sanction or civil damages arising from any illegal or underage use of this website, its affiliates, and/or its services.
